Jose A. Cruz, 34, of Clarksburg, West Virginia decided to pass and direct wind at the officer who was preparing a breathalyzer test on Tuesday. That act got the man another charge added to him.
Tuesday night Cruz was stopped for driving without his lights. Noticing that Cruz smelled like he had been drinking the police had him attempt a field sobiety test. He failed, three times. After the third try he was taken to the station for a breathalyzer test.

Patrolman T.E. Parsons was the unlucky officer to prepare the machine when Cruz scooted his chair towards him and sent of a whiff of colon cologne. Cruz then fanned the odor towards the officer.

The San Francisco Gate reports:

"The gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons," the complaint alleged.


In addition of the charge of passing gas Cruz faces charges of driving under the influence, driving without headlights and two counts of obstruction.

Cruz denies that he scooted towards Parson but does admit to the gassy passage but says that police denied his requests to use the washroom when he got to the station.


"I couldn't hold it no more," he said.


Cruz is also saying that he wasn't drunk and that he cooperated with the police. He says that while the police were preparing the breath test he was having an asthma attack.

Police say that Cruz resisted being secured for the ride to the hospital after the man requested asthma treatment.

Cruz isn't laughing about passing wind like he says he and the police were that night. Now he is afraid that his booty bomb will land him in jail.


"This is ridiculous," he said. "I could be facing time."
